Poisoning by tuna?

I highly doubt that this plaintiff will succeed in his lawsuit, unless there is compelling evidence to link his high consumption of tuna to such high levels of mercury, as to result in poisoning. The defense will argue that this individual has been consuming too much of the product and is therefore, responsible for his own health problems.
If he prevails, the case will open flood gates for similar lawsuits, which will lead to more litigation and subsequently, higher tuna prices. On the other hand, we all need consumer protection and if there is a problem, the industry should correct it, in order to prevent health risks to unsuspecting consumers.
Lawsuits of this nature work as an alarm mechanism for prevention of bigger problems for consumers in the future.
